Terms and Conditions of the FOTON online store

updated version of 25 June 2026

These Terms and Conditions govern the use of the FOTON online store at https://e-foton.eu, placing orders, concluding sales contracts, payments, delivery, complaints, withdrawal from the contract, product safety notices and the special rules for professional products, including industrial cells and battery-related components.

 

Provisions relating to Consumers and Privileged Entrepreneurs apply to the extent required by mandatory provisions of law. In cross-border EU/EEA sales, these Terms and Conditions do not deprive Consumers of any mandatory protection granted by the law of their country of habitual residence, where such protection applies.

§ 1 DEFINITIONS

Business Days – days from Monday to Friday, excluding public holidays in Poland.
Consumer – a natural person concluding a contract with the Seller for purposes which are outside that person's trade, business, craft or profession.
Account – a free electronic service enabling the Buyer to create an individual account in the Store, manage selected data and view order history.
Buyer – any person or entity placing an order or concluding a sales contract with the Seller via the Store.
Privileged Buyer – a Consumer or a Privileged Entrepreneur, to the extent such status is recognised under applicable mandatory law.
Professional Customer – a Buyer who purchases a Professional Product for business, professional or technical purposes, in particular for designing, manufacturing, servicing, testing or assembling battery packs, devices, power systems or other technical solutions, and who has the knowledge, equipment and procedures required to handle such products safely.
Industrial Cell – a single electrochemical cell, including in particular Li-ion, LiFePO4, NiMH or another cell offered in the Store as a technical component intended only for professional use, including installation in battery packs or devices equipped with appropriate electrical, mechanical and thermal protection.
Entrepreneur – a natural person, legal person or organisational unit conducting business or professional activity in its own name.
Privileged Entrepreneur – a natural person concluding a contract with the Seller directly related to that person's business activity where, under Polish law, the contract does not have a professional character for that person, in particular in light of the subject of business activity disclosed in CEIDG. This status is specific to Polish law and does not limit any mandatory rights granted to a Buyer under the law of another EU/EEA Member State.
Professional Products – goods marked in the Store as professional, B2B, industrial, component products, industrial cells, products for battery pack assembly, products for professional use or goods whose description states that they are not intended for Consumers.
EU/EEA Buyer – a Buyer whose delivery address, habitual residence or establishment is located in a Member State of the European Union or the European Economic Area other than Poland.
Collection Point – the collection point at ul. Stolarska 2, 34-300 Żywiec, Poland.
Terms and Conditions – these terms and conditions of the Store.
Store – the FOTON online store operated by the Seller at https://e-foton.eu.
Seller – FOTON Marcin Piela, ul. Stolarska 2, 34-300 Żywiec, Poland, NIP 5532432636, REGON 241853167, an entrepreneur entered in the Central Registration and Information on Business (CEIDG) in Poland.
Goods – movable items available in the Store that may be the subject of a sales contract.

§ 2 CONTACT WITH THE SELLER

  1. Seller's postal address: FOTON Marcin Piela, ul. Stolarska 2, 34-300 Żywiec, Poland.
  2. E-mail address for the Store: shop@e-foton.eu.
  3. Address for returning Goods in the event of withdrawal from the contract: ul. Stolarska 2, 34-300 Żywiec, Poland.
  4. Address for sending Goods subject to a complaint: ul. Stolarska 2, 34-300 Żywiec, Poland, unless the Seller provides another address or instructions for a given complaint.
  5. Product safety reports, including reports of accidents, overheating, ignition, leakage, mechanical damage, transport damage or any other dangerous event, should be sent without delay to: shop@e-foton.eu.
  6. For faster handling of a product safety report, the Buyer should provide, where possible: order number, product name, batch or marking, photos, description of the incident, information about the application, charging/discharging method, storage and transport conditions, and whether anyone was injured or property was damaged.

§ 3 TECHNICAL REQUIREMENTS

  1. To use the Store properly, the Buyer needs:
    • a device with access to the Internet,
    • an up-to-date web browser supporting JavaScript and cookies,
    • an active e-mail address.
  2. To place an order, the Buyer must provide the data required in the order form.
  3. For the purchase of Professional Products, the Seller may require business data, VAT number, company registration details or an additional statement confirming the professional character of the purchase.
  4. The Store may use technical safeguards, checkboxes or account verification mechanisms to confirm that the Buyer has read safety warnings and that the purchase of a Professional Product is made for professional purposes.

§ 4 SHOPPING IN THE STORE AND CONCLUSION OF THE CONTRACT

  1. Information presented in the Store, including descriptions of Goods, prices, availability and technical parameters, constitutes an invitation to conclude a contract within the meaning of Polish civil law and does not constitute a binding offer, unless the relevant content expressly states otherwise.
  2. To place an order, the Buyer adds selected Goods to the cart, selects the available delivery method and payment method, provides the data required for order processing, reads and accepts the Terms and Conditions, and confirms the order.
  3. By placing an order, the Buyer submits an offer to conclude a sales contract with the Seller.
  4. The sales contract is concluded when the Seller confirms acceptance of the order for fulfilment or starts fulfilling the order, whichever occurs first.
  5. The Seller will provide the Privileged Buyer with confirmation of the conclusion of the sales contract on a durable medium no later than upon delivery of the Goods.
  6. The Buyer may create an Account in the Store or purchase without registration, unless the purchase of a specific Professional Product requires a business Account, VAT number or additional verification of Buyer status.
  7. When placing an order for Professional Products, the Buyer confirms that the purchase is made for professional or business purposes and that the Goods will be used in accordance with their intended use, description, technical documentation, safety warnings and applicable product safety rules.
  8. The Seller may refuse to accept an order or may cancel an order before the contract is concluded if:
    1. the order includes a Professional Product and the Buyer has not provided information enabling confirmation of the professional character of the purchase;
    2. the Buyer refuses to make a required statement concerning the professional intended use of the Goods;
    3. the circumstances of the order indicate a risk that the Goods may be used contrary to their intended use, safety warnings or applicable law;
    4. there is an obvious error in price, description, availability or technical parameters;
    5. the Goods are unavailable or cannot be safely or lawfully delivered by the selected delivery method or to the selected destination;
    6. export, transport, product safety, battery, waste, customs, tax, sanctions or other mandatory rules prevent or materially restrict the fulfilment of the order.
  9. The Seller may use names, trademarks and model designations of manufacturers solely to identify the Goods, model, type, parameters or compatibility. Unless expressly stated at the relevant Goods, the Seller does not declare that it is an authorised distributor, representative, authorised importer or affiliated entity of any given manufacturer.
  10. The Store does not block access to the online interface solely due to nationality, place of residence or establishment of the Buyer. However, delivery, payment methods, availability of specific Goods and acceptance of specific orders may be limited for objective reasons, including product safety, transport restrictions, legal requirements, tax handling, payment security, product type or delivery address.

§ 5 PRICES, VAT AND PAYMENTS

  1. Prices visible in the Store are gross prices including VAT where VAT is applicable, unless the Store expressly indicates otherwise for a given Buyer, product type or transaction.
  2. The total order price includes the price of the Goods, delivery costs and any other costs shown to the Buyer before placing the order, where applicable.
  3. For EU/EEA Buyers, the final VAT rate and gross price may depend on the Buyer's country, delivery address, VAT status, type of Goods and applicable EU and Polish VAT rules. The final price shown at checkout before the order is placed is binding for the order unless there is an obvious error.
  4. Business Buyers from another EU Member State may be asked to provide a valid EU VAT number. The availability of intra-Community VAT treatment depends on applicable tax rules and proper verification of the data provided by the Buyer.
  5. Depending on the payment methods active in the Store, payment may be made in particular:
    1. by ordinary bank transfer to the Seller's bank account;
    2. through online payment methods available in the Store, including Shoper Payments / Autopay if enabled;
    3. by cash on delivery if available for a given order, destination and carrier;
    4. by another payment method indicated in the Store before placing the order.
  6. If advance payment is selected, the Buyer should pay for the order within 24 hours of placing the order, unless the Seller specifies another period.
  7. Failure to pay within the required period may result in cancellation of the order.
  8. Some payment methods may be available only immediately after placing the order or only for selected Goods, order values, destinations, currencies or delivery methods.

§ 6 ORDER FULFILMENT, DELIVERY AND CROSS-BORDER RESTRICTIONS

  1. The Seller is obliged to deliver Goods that conform to the contract.
  2. The order fulfilment time is indicated in the Store or in the confirmation of order acceptance.
  3. If advance payment is selected, the Seller will begin order fulfilment after the payment is credited or after receiving proper payment confirmation.
  4. If one order includes Goods with different fulfilment times, the order may be fulfilled within the time appropriate for the Goods with the longest fulfilment time, unless the Seller and the Buyer agree otherwise.
  5. The Store may deliver Goods to Poland and to selected EU/EEA Member States for which delivery is available in the Store at the time of placing the order. Availability of delivery to a given country does not mean that every product can be shipped to that country.
  6. Delivery may be available in particular to the following countries, subject to current options in the Store: Poland, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Greece, Spain, Netherlands, Ireland, Lithuania, Luxembourg, Latvia, Germany, Portugal, Romania, Slovakia, Slovenia, Sweden, Hungary and Italy.
  7. Goods purchased in the Store are delivered using the delivery methods available during checkout, in particular by courier. Personal collection at the Seller's Collection Point may be available only if shown during checkout or agreed with the Seller.
  8. For Goods containing batteries, Industrial Cells, lithium cells, battery modules, used/reclaimed cells, damaged-return items or other Goods subject to transport restrictions, delivery may be limited due to carrier rules, dangerous goods rules, customs/tax rules, product safety requirements or the risk of unsafe shipment.
  9. The Seller may refuse shipment or propose a different delivery method if the selected method does not allow safe or lawful delivery of the Goods.
  10. The Buyer should inspect the shipment upon delivery in a manner customary for the selected carrier. If the package is visibly damaged, wet, deformed, overheated, has an unusual smell, shows signs of leakage, smoke or other safety risks, the Buyer should not use the Goods and should immediately contact the Seller and, where appropriate, the carrier.
  11. The Seller is not responsible for delays caused by circumstances beyond the Seller's reasonable control, including customs or tax procedures, carrier delays, force majeure, regulatory restrictions or safety holds, without prejudice to mandatory Consumer rights.

§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. A Consumer has the right to withdraw from a distance contract concluded with the Seller via the Store within 14 days without giving any reason, subject to the exceptions set out in § 8 and mandatory provisions of applicable law.
  2. A Privileged Entrepreneur has the right to withdraw from the contract only to the extent such right results from Polish law or other applicable mandatory provisions.
  3. The withdrawal period expires after 14 days from:
    1. the day on which the Consumer acquired physical possession of the Goods or on which a third party other than the carrier and indicated by the Consumer acquired physical possession of the Goods;
    2. the day on which the Consumer acquired physical possession of the last item or on which a third party other than the carrier and indicated by the Consumer acquired physical possession of the last item, in the case of a contract covering multiple items delivered separately;
    3. the day of conclusion of the contract, in the case of services or digital content not supplied on a tangible medium.
  4. To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement, for example by letter or e-mail sent using the contact details in § 2.
  5. The Consumer may use the model withdrawal form in Annex 1, but this is not mandatory.
  6. To meet the withdrawal deadline, it is sufficient for the Consumer to send the withdrawal statement before the withdrawal period expires.
  7. In the event of withdrawal, the Seller will reimburse all payments received from the Consumer, including the costs of standard delivery of the Goods, except for additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller.
  8. The Seller will make the reimbursement without undue delay and no later than 14 days from the day on which the Seller was informed of the Consumer's decision to withdraw from the contract.
  9. The Seller will make the reimbursement using the same payment method as the Consumer used for the original transaction, unless the Consumer agrees to another method and the Consumer does not incur any fees as a result.
  10. The Seller may withhold reimbursement until the Seller receives the Goods back or until the Consumer provides proof of having sent the Goods back, whichever occurs first.
  11. The Consumer should return the Goods to: FOTON Marcin Piela, ul. Stolarska 2, 34-300 Żywiec, Poland, without undue delay and in any event no later than 14 days from the day on which the Consumer informed the Seller of withdrawal. The deadline is met if the Goods are sent back before the 14-day period expires.
  12. The Consumer bears the direct cost of returning the Goods, unless mandatory law or the Seller's individual communication provides otherwise.
  13. The Consumer is liable only for any diminished value of the Goods resulting from handling the Goods other than what is necessary to establish their nature, characteristics and functioning.
  14. For Goods that, due to their nature, cannot be returned by ordinary post or the least expensive standard return method, the Consumer may have to bear the direct return costs. Where possible, the Seller informs the Consumer of the estimated return costs in the product description, during checkout or when providing return instructions.
  15. Goods containing batteries, lithium cells or Industrial Cells must be returned in a manner compliant with safety instructions, carrier requirements and applicable transport rules. The Consumer must not return Goods that are damaged, leaking, swollen, overheated, burnt, short-circuited or otherwise unsafe without first contacting the Seller for safety instructions.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1. The right of withdrawal from a distance contract does not apply to contracts where an exception applies under mandatory law, in particular:
    1. for Goods made to the Consumer's specifications or clearly personalised;
    2. for Goods which are liable to deteriorate or expire rapidly;
    3. for sealed Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
    4. for Goods which, after delivery and by their nature, are inseparably mixed or connected with other items;
    5. for sealed audio or video recordings or sealed computer software unsealed after delivery;
    6. for newspapers, periodicals or magazines, except for subscription contracts;
    7. for digital content not supplied on a tangible medium where performance has begun with the Consumer's prior express consent and acknowledgement of the loss of the right of withdrawal, where such exception applies under mandatory law.
  2. Products sold to Professional Customers for professional use are not subject to the Consumer right of withdrawal unless the Buyer has Consumer status or mandatory law provides otherwise.
  3. Any exception is applied only to the extent permitted by mandatory provisions of law.

§ 9 COMPLAINTS, LEGAL GUARANTEE OF CONFORMITY AND PRODUCT SAFETY REPORTS

  1. Complaints concerning Goods or the operation of the Store may be submitted to the Seller's postal address or e-mail address indicated in § 2.
  2. The complaint should, where possible, include: order number, Buyer's contact details, product name, description of the problem, date of occurrence, photos or videos if relevant, and the Buyer's requested remedy.
  3. The Seller will respond to complaints within 14 days, unless mandatory law requires a different period.
  4. In relation to Consumers, the Seller is liable for the conformity of Goods with the contract under mandatory consumer protection rules. Consumer remedies may include repair, replacement, price reduction or withdrawal from the contract, in accordance with applicable law.
  5. In cross-border EU/EEA Consumer sales, the Consumer's statutory conformity rights are governed by mandatory EU and national consumer protection rules applicable to the contract, and these Terms and Conditions do not limit such rights.
  6. If the complaint requires the Goods to be delivered to the Seller, the Seller will provide instructions. In the case of a Consumer complaint accepted under mandatory law, the return of non-conforming Goods is handled at the Seller's expense to the extent required by law.
  7. If a commercial guarantee has been granted for particular Goods, information about that guarantee and its terms is available in the product description, guarantee document or another durable medium. A commercial guarantee does not limit the Consumer's statutory rights.
  8. For Buyers who are not Consumers or Privileged Buyers, the Seller's liability under statutory warranty for defects is excluded to the fullest extent permitted by Polish law, unless the Seller expressly agrees otherwise in writing or mandatory law provides otherwise.
  9. For Buyers who are not Consumers or Privileged Buyers, any liability of the Seller, to the extent permitted by law, is limited to the value of the order and to 1 year from delivery of the Goods.
  10. Product safety reports must be made immediately if the Buyer becomes aware of an accident, fire, overheating, leakage, swelling, explosion, electric shock, injury, property damage or another event that may indicate a safety risk related to Goods purchased from the Seller.
  11. The Buyer must not continue using, charging, discharging, transporting, reselling or integrating Goods that may be unsafe. The Buyer should secure the Goods in a safe place, prevent short circuits, keep them away from flammable materials and follow the Seller's safety instructions.
  12. The Seller may request additional information and may notify relevant market surveillance authorities, manufacturers, importers, distributors, carriers or other entities where required or justified by product safety rules.
  13. Consumers may use out-of-court complaint and redress mechanisms available under Polish or EU rules, including mediation or consumer arbitration mechanisms available through competent consumer protection bodies. EU/EEA Consumers may also contact the European Consumer Centres Network for cross-border consumer assistance. The former EU Online Dispute Resolution platform is no longer available.

§ 10 PERSONAL DATA

  1. The Seller is the controller of personal data provided by the Buyer when using the Store.
  2. Detailed information on personal data processing, including purposes, legal bases, recipients, retention periods and rights of data subjects, is provided in the Privacy Policy available in the Store.
  3. The purpose of processing the Buyer's data provided in connection with purchases is to handle orders, conclude and perform contracts, fulfil legal obligations, handle complaints, carry out accounting and tax duties, ensure product safety, and establish, pursue or defend claims.
  4. The legal bases for processing may include in particular: performance of a contract or steps taken at the request of the Buyer before concluding a contract; a legal obligation incumbent on the Seller; and the Seller's legitimate interest consisting in handling claims, ensuring security and product safety, and preventing abuse.
  5. Providing data is voluntary but necessary to conclude and perform a sales contract, create an Account, process a complaint or provide other Store services. Failure to provide required data may prevent the Seller from processing the order or providing a service.
  6. The Buyer has the rights provided under the General Data Protection Regulation, including the right of access, rectification, erasure, restriction of processing, data portability, objection and the right to lodge a complaint with the President of the Personal Data Protection Office in Poland or another competent supervisory authority.

§ 11 PROFESSIONAL PRODUCTS AND INDUSTRIAL CELLS

  1. This section applies to Professional Products, in particular single Li-ion, LiFePO4, NiMH industrial cells, reclaimed or disassembled cells, cells for battery pack construction, modules, power components, BMS/PCM elements and other Goods marked in the Store as B2B, professional, industrial or not intended for Consumers.
  2. Professional Products are not intended for ordinary consumer use. They are intended only for Professional Customers with the knowledge, qualifications, tools and procedures enabling safe storage, testing, transport, assembly and use.
  3. Industrial Cells are technical components. They are not ready-to-use consumer batteries, are not standalone power sources intended for free use by end users, and may not have individual protection against short circuit, overcharge, over-discharge, overheating, overcurrent or mechanical damage.
  4. Industrial Cells may be used only as part of a professionally designed and manufactured pack, module or device equipped with an appropriate BMS/PCM, insulation, enclosure, mechanical, thermal and electrical protection, and operating parameters consistent with the technical documentation of the relevant model.
  5. Industrial Cells must not be used as loose, single, replaceable consumer batteries, in particular in e-cigarettes, vape devices, flashlights, toys, fans, power banks, RC devices, portable devices or other consumer devices, unless the cell is part of a professionally designed, protected and legally compliant pack or device.
  6. The Buyer must not carry, store or transport loose cells in pockets, bags, containers with metal objects or in any way that may allow the terminals to short circuit. Terminal short circuit may cause overheating, fire, explosion, burns, property damage or other harm.
  7. The Buyer must follow the technical documentation, datasheets, safety data sheets, safety instructions, information in the product description and generally accepted safe handling rules for cells, batteries and accumulators.
  8. Cells must not be used, charged, discharged, assembled or resold if they have damaged insulation, sleeve, terminal, vent, casing, signs of crushing, puncture, overheating, corrosion, leakage, deformation, electrolyte smell or voltage outside a safe range.
  9. Cells must not be soldered directly to terminals, opened, disassembled, crushed, punctured, thrown into fire, exposed to high temperature, moisture, short circuit, reverse polarity, excessive charging or discharging currents, or used outside the manufacturer's parameters or the product description.
  10. If Goods are described as reclaimed, disassembled or depacketed, this means that they originate from disassembly of a battery pack or another original configuration. Such cells may have insignificant cosmetic traces resulting from disassembly, which should not affect insulation, terminals, sealing or safety. The Seller does not intentionally offer cells with visible insulation damage or mechanical damage that may affect safety.
  11. Before assembly or use, the Buyer should conduct quality and safety checks appropriate for the intended application, including checking voltage, internal resistance, insulation condition, terminal condition, batch consistency and compatibility with the pack or device design.
  12. Information about maximum current, recommended current, capacity, voltage, chemistry, size and other parameters is technical information and must be interpreted together with the documentation of the relevant model and the design of the final pack or device. Indication of a maximum parameter does not mean a recommendation for continuous operation at the limit and does not guarantee safety in any arbitrary application.
  13. The Buyer is responsible for proper design, selection, testing, assembly, protection, labelling, documentation and conformity assessment of the pack, device or system in which the Professional Product is used, unless mandatory law provides otherwise.
  14. If the Buyer resells, integrates, assembles into a pack, repackages, rebrands, changes the intended use or makes a Professional Product available to another entity, the Buyer must ensure compliance with applicable rules, including product safety, batteries, transport, waste, user information, language of warnings and technical documentation requirements.
  15. The Seller may refuse to sell a Professional Product or suspend order fulfilment if the Buyer does not confirm the professional character of the purchase, does not provide required business data, does not accept safety warnings or if circumstances indicate a risk of use contrary to the intended purpose.
  16. The Seller may require an additional statement that:
    1. the Buyer acts as a Professional Customer;
    2. the purchase is not made for consumer use;
    3. the Goods will be used in accordance with their intended use, documentation and safety warnings;
    4. the Buyer has the qualifications, procedures and technical means required for safe handling of the Goods;
    5. the Buyer will not offer Industrial Cells to Consumers as loose, standalone consumer batteries.
  17. For brands and models of cell manufacturers or other components, trade names, trademarks, model markings and parameters are provided solely to identify the Goods. Unless the Store expressly states authorisation, the Seller does not declare the status of authorised distributor, representative, authorised importer or affiliated entity of the manufacturer.
  18. This section does not exclude or limit any mandatory rights of Consumers or Privileged Buyers where such rights apply.

§ 12 APPLICABLE LAW, JURISDICTION AND FINAL PROVISIONS

  1. The Buyer is prohibited from providing unlawful content.
  2. Each order placed in the Store constitutes a separate procedure for concluding a sales contract and requires separate acceptance of the Terms and Conditions.
  3. Contracts concluded through the Store may be concluded in English. The Polish-language version may be used for the Polish store. The version accepted by the Buyer during checkout applies to the contract, subject to mandatory provisions of law.
  4. These Terms and Conditions and contracts concluded through the Store are governed by Polish law, subject to mandatory consumer protection rules that may apply to Consumers in their country of habitual residence.
  5. In relation to Consumers, the choice of Polish law does not deprive the Consumer of the protection of mandatory provisions that would apply under the law of the Consumer's country of habitual residence, where such rules apply.
  6. In relation to Consumers, jurisdiction is determined by mandatory EU and national rules on consumer contracts. Nothing in these Terms and Conditions limits a Consumer's right to bring proceedings before a court that has jurisdiction under mandatory consumer protection rules.
  7. In disputes with Buyers who are not Consumers or Privileged Buyers, the competent court will be the court having jurisdiction over the Seller's registered address in Poland, unless mandatory law provides otherwise.
  8. The Seller may amend these Terms and Conditions for important reasons, in particular in the event of changes in law, Store operation, payment methods, delivery methods, product safety requirements, decisions of authorities, court judgments, guidelines of supervisory authorities, tax or transport rules, or changes in assortment.
  9. Changes to the Terms and Conditions do not affect sales contracts concluded before the changes enter into force, unless mandatory law provides otherwise.
  10. If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions remain in force, and the invalid or unenforceable provision should be interpreted or replaced in a manner closest to its purpose and compliant with law.
  11. These Terms and Conditions do not exclude or limit any rights of Consumers or Privileged Buyers arising from mandatory provisions of law.

These Account Terms govern the free electronic Account service in the Store. Provisions concerning Consumers and Privileged Entrepreneurs apply to the extent required by mandatory law.

§ 1 DEFINITIONS

Consumer – a consumer within the meaning of § 1 of the Store Terms and Conditions.
Account – a free electronic service enabling the Buyer to create an individual account in the Store.
Buyer – any entity using the Store or purchasing in the Store.
Privileged Buyer – a Consumer or Privileged Entrepreneur, to the extent required by mandatory law.
Store – the FOTON online store operated at https://e-foton.eu.
Seller – FOTON Marcin Piela, ul. Stolarska 2, 34-300 Żywiec, Poland, NIP 5532432636, REGON 241853167.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS

  1. To create and use an Account, the Buyer needs an active e-mail address, a device with Internet access and an up-to-date web browser supporting JavaScript and cookies.

§ 4 ACCOUNT

  1. Creating an Account is voluntary and free of charge.
  2. The Account enables the Buyer to use additional Store functions, including viewing order history, checking order status and editing selected data.
  3. To create an Account, the Buyer completes the appropriate form in the Store.
  4. When the Account is created, an agreement for maintaining the Account is concluded for an indefinite period.
  5. The Buyer may resign from the Account at any time without cost.
  6. To resign from the Account, the Buyer should send a resignation request to shop@e-foton.eu. This will result in termination of the Account agreement and deletion of the Account, subject to data retention required by law or legitimate claims.
  7. The Seller may provide additional verification of a business Account where the Buyer wants to purchase Professional Products, especially Industrial Cells.

§ 5 COMPLAINTS

  1. Complaints concerning the Account may be submitted to shop@e-foton.eu.
  2. The Seller will respond to complaints within 14 days.
  3. Consumers may use out-of-court complaint and redress mechanisms available under Polish or EU rules, including mediation or consumer arbitration mechanisms available through competent consumer protection bodies. EU/EEA Consumers may also contact the European Consumer Centres Network for cross-border assistance. The former EU Online Dispute Resolution platform is no longer available.

§ 6 PERSONAL DATA

  1. The Seller is the controller of personal data provided by the Buyer when using the Account.
  2. Data is processed for the purpose of providing the Account service, handling requests, ensuring security and establishing, pursuing or defending claims.
  3. Detailed information is provided in the Privacy Policy available in the Store.

§ 7 FINAL PROVISIONS

  1. The Buyer is prohibited from providing unlawful content.
  2. The Account agreement may be concluded in English or Polish, depending on the Store version used.
  3. The Seller may amend these Account Terms for important reasons, including changes in law, Store functionality, security requirements or technical operation.
  4. The Buyer will be informed about planned changes at least 7 days before they enter into force by e-mail sent to the address assigned to the Account.
  5. If the Buyer does not accept the planned changes, the Buyer may terminate the Account before the changes enter into force.
  6. In disputes with Buyers who are not Consumers or Privileged Buyers, the competent court will be the court having jurisdiction over the Seller's registered address in Poland, unless mandatory law provides otherwise.

These Newsletter Terms govern the free Newsletter service provided by electronic means.

Newsletter – a free electronic service consisting of sending ordered messages concerning the Store, including information about offers, promotions and new products.
Service Recipient – any person or entity using the Newsletter service.

Store – the FOTON online store operated at https://e-foton.eu.

§ 2 NEWSLETTER

  1. Using the Newsletter is voluntary and free of charge.
  2. To use the Newsletter, the Service Recipient needs a device with Internet access, a web browser and an active e-mail address.
  3. Newsletter messages are sent to the e-mail address provided by the Service Recipient.
  4. To subscribe, the Service Recipient provides an e-mail address in the Store and, if the double opt-in mechanism is used, confirms the subscription using the link sent to that address. The Newsletter agreement is concluded when the subscription is confirmed or when the Store otherwise indicates completion of subscription.
  5. The Service Recipient must provide a correct e-mail address.
  6. Each Newsletter message contains information about the possibility of unsubscribing and a link or instruction enabling unsubscription.
  7. The Service Recipient may unsubscribe at any time without giving a reason and without cost, using the unsubscribe link or by sending a request to shop@e-foton.eu.
  8. Unsubscribing results in termination of the Newsletter service.
  9. Newsletter content concerning Professional Products or Industrial Cells does not constitute an offer of consumer use and does not remove the B2B/professional restrictions stated in the Store and these Terms and Conditions.
